In Australia, every employee is entitled to a baseline level of workplace protections. These are known as the National Employment Standards (NES) — and they apply to all employees covered by the national workplace relations system.

These standards override any award or employment contract, meaning no agreement can provide conditions that fall below the NES.


📘 What Employers Must Provide New Staff

When onboarding a new employee, you must give them:

  • Fair Work Information Statement (for all new employees)

  • Casual Employment Information Statement (for all new casual employees)

These documents ensure employees understand their rights from day one.

The NES cover the minimum entitlements for all employees, including:

  • Maximum weekly hours

  • Requests for flexible working arrangements

  • Casual employment

  • Parental leave and related entitlements
